Wills

 

A Will is a legally enforceable document that states how you want your assets distributed and your affairs finalized after you pass away.  If you have children below the age of 18 at home, it is important to include guardianship appointment in your will.  A will places your decisions in the hands of the judge who presides over your estate transfer. It also provides a way for you to give direction and insight into how you want your estate distributed.

Trusts

A revocable trust makes the management and transfer of assets a more fluid process.  It is a legal tool that can be used to manage your personal and real property during your life. It also provides detailed instructions for the management and eventual distribution of your assets after your death.  However, if you want your child to have the opportunity to attend college, or you have a loved one with special needs, you may wish to set up an irrevocable trust fund to address these situations.  I can write and help you establish a trust to meet your needs.  To learn more estate planning basics click here.

Power of Attorney and Healthcare Directive

​

A power of attorney may be used when you want to give another person the authority to act on your behalf when certain circumstances exist.  You may want to provide a healthcare power of attorney, which allows that person to represent you and to make decisions about your health when you are incapacitated.  A durable power of attorney may be used to enable another to represent you in all legal areas of your life if you are incapacitated.

A healthcare directive, or a living will, is a legal document that makes your wishes known in the event you become incapacitated.  It allows a person you choose to make medical decisions on your behalf if you are incapacitated.

Probate

 

Probate is the legal process through which liabilities are paid and assets are distributed after death.  Probate can be minimized through careful and thorough estate planning.  To learn more about estate litigation click here.
