Divorce

The process of getting a divorce decree can be simple or quite complex depending on the circumstances, and whether your spouse is willing to work with you during this process.  I will help you through your divorce with as little conflict as possible.  I will work with you to determine your best possible outcome, and help you understand attending legal issues so that you are able to make informed decisions.  Even the most straight forward simple divorce includes some conflict.  Regardless of the complexity of your situation, I will work with you to get you the best possible outcome.

Guardianship (Incapacitated Adult or Child)

The guardianship of a child establishes a person to care for a minor child if that child's parents are unable to do so themselves. This may be established as part of a comprehensive estate planning strategy. Guardianship may also be used to protect vulnerable adults who are unable to care for themselves by assigning a legal guardian.

Paternity

When a child is born to married parents the legal presumption is that the husband is the father of that child. However, when a child is born to non-married parents, there is no presumed paternity. Paternity may need to be established in situations such as divorce, child custody, and support negotiations.

Prenuptial Agreement

A "prenup" isn't just for the wealthy and celebrities. The prenuptial agreement allows you and your spouse to determine how you would like property divided in the event of divorce. Common reasons for a prenuptial agreement is to keep assets separate that were separate before the marriage took place, or to protect the inheritance of children from a prior marriage.  Prenuptial agreements are really quite affordable.  To read the Utah Uniform Premarital Agreement Act click here.
